311.05 Legal Action Against Liable Relatives (AAM)

Refer a case to the District Office Supervisor for review when a liable relative is determined able to contribute and they:

. refuse to contribute, or

. refuse to supply adequate information regarding their ability to contribute.

Do not deny or terminate assistance if the legally liable relative fails to cooperate or contribute support. Based on the facts, the DFA Supervisor may refer the case to DHHS's Chief of Legal Services, Office of Program Support. The Chief of Legal Services determines if a referral to the Attorney General's Office should be made in order to pursue legal action against the liable relative.
