317.01 Reimbursement - Financial Assistance (AAM)

Applicants and recipients of financial assistance under the OAA, ANB, and APTD programs must acknowledge their obligation of reimbursement and that a notice of lien may be filed against any real property owned by the applicant/recipient or spouse, severally or jointly, after the date that financial assistance begins. To be considered spouses, a couple must not be divorced or legally separated.

Advise the applicant or recipient that:

. such a lien will not be enforced so long as the individual or spouse are still living, and for so long as the property is lawfully occupied by the recipient and/or surviving spouse, unless the property is voluntarily sold or refinanced while DHHS has a lien in place;

. a claim may be filed against the individual's or spouse's estate to satisfy DHHS's claim for reimbursement of financial assistance granted; and

. if DHHS intends to file a notice of lien on the individual's real property, the individual will receive a notice and will have the opportunity to appeal the lien placement.

Instruct the individual and their spouse (if applicable), or the ANB child's parent (on behalf of the child), to complete DFA Form 770, Reimbursement Agreement and Acknowledgment. Deny or terminate assistance if the individual, the individual's spouse, or ANB child's parent(s) fail or refuse to complete the financial assistance portion of DFA Form 770.

*Scan the original DFA Form 770 and a copy of any deeds into the individual's electronic case record*.
