615.01 ANB Parental Deeming Principles (AAM)

Deem income and resources from parent(s) to an Aid to the Needy Blind (ANB) applicant or recipient during the ANB financial eligibility and benefit allotment determination process, when the ANB applicant or recipient is:

       under the age of 18; and

       living with their parent or parents.

 

ANB parental deeming does not apply in the following instances:

       when determining eligibility for ANB medical assistance; or

       if the parents identified for deeming in the ANB financial assistance case are already receiving any category of Financial Assistance to Needy Families (FANF) or State Supplement Program (SSP) financial assistance.

 

Calculate the available deemed income (ADI) of the parent(s) to the ANB child as follows:

Subtract the Child Allocation figure from parental unearned income for each unmarried sibling of the ANB applicant or recipient who is not also receiving ANB assistance, and is verified to be currently living in the home of the ANB applicant or recipient. The sibling must be under age 18, or under age 20 if a student. See the table below for figures.

If the Child Allocation figure is greater than parental unearned income, or there is no unearned income, subtract the excess child allocation amount from the parents’ combined earned income.

Subtract a $20 general income exclusion from any remaining parental unearned income.

If the remaining unearned income is less than the $20 general income exclusion, subtract the remainder of the $20 from the parents’ combined earned income.

Subtract $65 from the remaining parents’ combined earned income. Only one $65 deduction is allowed in the deeming process; both parents are not allowed a $65 deduction, even if both parents are working. Allow any other allowable verified deductions as listed in AAM 605DEDUCTIONS.

Subtract ½ of the remaining earned income from the result of Step 5.

Add the result of Step 3 (countable parental unearned income) to the result of Step 6 (countable parental earned income).

Subtract the Parental Living Allowance from the result of Step 7, which is based on the number of parents in the ANB child’s household. See the table below for figures.

The income remaining after the completion of Step 8 is the parental ADI deemed to the ANB child’s cash assistance budget as unearned income.

 

Only one ADI amount is calculated for the ANB financial case even if there is more than one eligible ANB child in the household. If there is more than one eligible ANB child in the household, the parental ADI is divided equally between or among the other eligible ANB recipients.

Example: If a family has 2 ANB children in the household and the parental ADI is $3,000, the ADI deemed to each child as unearned income is $1,500 ($3,000 / 2 = $1,500.) when determining the children’s eligibility for ANB cash assistance and amount of the cash grant.

Calculate the available deemed resources (ADR) of the parent(s) to the ANB child as follows:

When determining the available deemed resources for parents of ANB financial applicants and recipients under the age of 18, a “protected” resource amount is allowed. Any parental resources that exceed the protected amounts in the table below, are deemed to the ANB financial applicant or recipient under the age of 18. Current policy regarding counted and excluded resources, and current policy regarding the ANB resource limit, apply during the ANB parental resource deeming process:

Example: An ANB applicant under the age of 18 is living with both parents and the parents’ countable resources, using current policy regarding countable and excluded resources, totals $15,000. The protected amount is $3,000 for the parental ANB resource deeming process when the applicant lives with both parents, so a total of $12,000 is deemed towards the ANB applicant’s financial assistance case. Since the ANB resource limit is $1,500, the ANB applicant is over the resource limit for ANB financial assistance and is therefore ineligible for an ANB financial grant.

ANB parental deeming to an ANB financial applicant or recipient ends as of the month following the month in which the child turns 18.
