In this Part, assets include all income and resources of a financial assistance or institutionalized medical assistance applicant/or recipient or of the individual's spouse (See Glossary ). Policy on the transfer of assets differs based on the type of assistance requested and affects transfers made 8/11/93 or later. Transfer of Assets applies only to HCBC or institutionalized MA cases. It does not affect other MA only cases. Evaluate asset transfers to determine if the individual received fair market value and if the transfers were made for purposes of qualifying for financial or institutionalized medical assistance. Because of specific legal requirements for implementing policy on transferring assets, rulemaking language has been used in this Part.
