419.03 Determining the Protected Resource Amount SR 96-57, 01/97 (AAM-A)

Determine the protected resource amount for the community spouse when the institutionalized individual files an application for medical assistance. The protected resource amount is the highest of the following figures:

• maximum spousal resource standard—$79,020.00,

• minimum spousal resource standard—at least $15,804.00,

• amount transferred to community spouse by a court support order, or

• amount determined by the Department’s Office of Fair Hearings.
