209.09 Incapacity (FAM)

A child is deprived of parental support or care when a parent is physically or mentally incapacitated and such incapacity is expected to last for at least 30 continuous days. Incapacity is defined as a "physical or mental defect, illness, or impairment which substantially reduces or eliminates the parent’s ability to support or care for the child."
