The Special Investigations Unit (SIU) is responsible for referring cases for court prosecution. If the individual is found guilty of an intentional program violation (IPV) by a court of law, the SIU notifies all parties involved of the disqualification imposed.
The SIU initiates the disqualification period.
A court of appropriate jurisdiction can reverse the disqualification of an individual previously found guilty of an IPV through a hearing or a waiver of a hearing. When this occurs, the individual must be reinstated and the household’s benefits restored.
