141 ADVANCE NOTICE PERIOD (ANP) SR 96-14, 05/96 (FAM-A)

Notify individuals in advance of termination of assistance, a decrease in the level of eligibility, or a decrease in the benefit amount. The time frame between the date the NOD is generated and the date the action actually takes effect is called the advance notice period (ANP).

Exception: An advance notice period applies when positive and negative changes occur at the same time and result in a negative action .

The standard ANP is 10 calendar days. Under some circumstances the ANP is not required, is reduced to 5 calendar days, or is increased to 30 days. The effect of the ANP on benefits follows:

• Financial Assistance — Terminating cases receive only payments due prior to the expiration of the ANP. Decreasing cases receive the lower payment for the payroll in which the ANP expires.

• Medical Assistance — Terminations are effective on the day the ANP expires. Decreases in eligibility level are effective the day after the ANP expires.
