165 TERMINATION OF FINANCIAL ASSISTANCE SR 98-51, 12/98 (FAM-A)

Terminating cases receive only payments due prior to the expiration of the advance notice period (ANP).

If the individual being terminated is the only eligible child in the TANF case, terminate the entire case.

Exception: If the only child in the TANF case is an SSI recipient, the caretaker relative may still be eligible. See Part 211, COMPOSITION OF ASSISTANCE GROUPS.

If the individual receives financial and medical assistance and financial assistance is terminating, determine whether any of the individuals are still eligible for any medical assistance.

• If the assistance group is eligible as categorically needy or medically needy, continue medical assistance at the appropriate level.

• If the assistance group is not eligible, determine individual eligibility for other medical assistance programs. Terminate medical assistance for each individual who is not eligible for any type of medical assistance. Terminate medical assistance for the case if no individual is found eligible for any medical assistance program.

Exceptions:

• When an individual receiving TANF reaches age 65, offer to transfer the individual to OAA-related assistance. Transfer an MA-only individual to an OAA case without a separate Form 800 or 800H if they indicate that they wish to receive OAA medical assistance-only.

• When a child with severe disabilities (CSD) reaches the age of 18, or is under the age of 20 and a full-time student in a secondary school or the equivalent and living in the home of a specified relative, offer to transfer the individual to APTD-related assistance without a separate Form 800 or 800H.

• When a child with severe disabilities who is eligible for home care (HC-CSD) reaches the age of 18, offer to transfer the individual to APTD-related assistance without a separate Form 800 or 800H.
