209.09 Incapacity SR 94-04, 04/94 (FAM-A)

A child is deprived when a parent is physically or mentally incapacitated. Incapacity is defined as a "physical or mental defect, illness, or impairment which substantially reduces or eliminates the parent’s ability to support or care for the child."
