209.17 Incapacity: Increased Earnings by an Incapacitated Parent SR 97-09, 03/97 (FAM-A)

When an incapacitated parent’s earnings or hours of employment increase, it may signal a change in the status of the incapacity. Notify OMS of the increases. If the case income exceeds TANF financial assistance limits, OMS need not respond until the case is once again being processed for financial assistance. Check the case to determine eligibility for MA-only or 12-month extended medical assistance (see Chapter 100, Parts 171 and 173 ).

If the increase in earnings or hours of employment does not exceed TANF financial assistance limits, ask OMS to review the parent’s incapacity. Check the case for a temporary adjustment period (see Section 209.35).
