209.21 Unemployment: Definition of Unemployed SR 97-09, 03/97 (FAM-A)

Initial eligibility: The PWE must have worked less than 100 hours in the 30-day period prior to anticipated receipt of assistance. Anticipated receipt is the first day of the payroll period covered by an initial TANF check. For MA-only, anticipated receipt is the date of application, unless the individual is eligible for 3-month retroactive benefits or is not eligible in the first month. For In and Out medical assistance, anticipated receipt is the first day of eligibility.

Exception: The PWE may have worked 100 or more hours in the 30 days prior to anticipated receipt of assistance as long as they worked less than 100 hours in each of the preceding two 30-day periods and are also expected to work less than 100 hours in the next 30-day period.

Continuing Eligibility: The PWE who currently receives benefits must have worked less than 100 hours in a given calendar month.

Exception: The PWE may work 100 or more hours in a calendar month if they worked less than 100 hours in each of the preceding 2 calendar months and also expect to work less than 100 hours in the next calendar month.
