303.17 Medicaid-Only Residency: Individuals Placed Out-of-State SR 94-04, 04/94 (FAM-A) |
When a state places any individual in an out-of-state institution, continue Medicaid beyond 30 days. The individual keeps residency in the original state whether or not they intend to remain a New Hampshire resident. However, if the individual is competent and leaves the institution, then residency reverts to the state where they are physically located.
Example
A Poverty-Level Pregnant Woman is placed in a Massachusetts institution for specialty care not available in New Hampshire. Her Medicaid-only benefits continue to be the responsibility of New Hampshire.
A state has not arranged a placement in an out-of-state institution when it:
• provides an individual with basic information about another state’s Medicaid program or the availability of health care in another state, or
• assists a competent individual in locating an institution in another state.
