307.07 Medical Assistance: Public Institutions SR 99-09, 03/99 (FAM-A)

A medical assistance recipient who has been an inpatient at a public institution for 30 days or longer is no longer eligible for benefits. That individual is closed from the case with no advance notice period.

Medical institutions or foster care institutions are not public institutions. A public, as opposed to private, institution is one that is monitored or administered by government.

New Hampshire has only one public institution, NH Hospital, which in turn comprises several satellite programs, such as the Anna Philbrook Center.

Individuals Released within 60 Days:

Some individuals who lose eligibility are released from the institution after 60 days. These individuals must reclaim eligibility status by providing information on any changes or reapply for benefits.

Individuals must reapply for benefits when one of the following applies:

• their redetermination was due by the end of their stay in the public institution,

• they want to apply for a different program or category of assistance, or

• Medicaid Administration Bureau has determined that they failed to cooperate with the medical review process without good cause.

Permit individuals to update their eligibility status when their cases have not yet closed and they are not required to reapply. Personally interview them and complete Form 782, Report of Post Discharge Circumstances.
