311.15 Refusal to Cooperate SR 97-03, 02/97 (FAM-A)

When an individual refuses or fails to cooperate, deduct 25% from the payment standard for the group size. This deduction is taken before any additional sanctions are applied. If the payment for a group size of 2 is $481, a 25% reduction makes the new payment standard $361. Any additional sanctions are applied to the $361 payment standard.

When an individual refuses to cooperate at the eligibility interview, advise applicants of the action that will be taken.

When an individual refuses to cooperate who is already receiving benefits, advise applicants of the action that will be taken.

Reinstate individuals who:

• request a fair hearing during the advance notice period,

• cooperate during the advance notice period, and

• claim good cause, but reinstate the case only after they have submitted the required evidence.
