311.15 Refusal to Cooperate SR 98-51, 12/98 (FAM-A)

When an individual refuses or fails to cooperate, deduct 25% from the payment standard for the group size. This deduction is taken before any additional sanctions are applied. When recalculating income eligibility for assistance, allow all deductions and disregards for which the individual is eligible. *

When an individual refuses to cooperate at the eligibility interview, advise applicants of the action that will be taken.

When an individual refuses to cooperate who is already receiving benefits, advise applicants of the action that will be taken.

Remove the sanction for individuals who:

• request a fair hearing during the advance notice period,

• cooperate during the advance notice period, or

• claim good cause, but remove the sanction only after they have submitted the required evidence.
