313.01 Medical Assistance Cases: Who Is Liable for Support? SR 99-03, 02/99 (FAM-A)

In medical assistance cases, the following relatives are required to contribute to the support of an individual receiving medical assistance, when that individual is under 21 [e.g., an individual receiving Medical Coverage for Pregnant Women (MCPW)], or when the individual is blind or disabled and has opted not to apply for another category of assistance:

• husband or wife

• natural parent

• adoptive parent

• stepparent

In medical assistance cases, contributions by relatives that are made directly to the individual and are not assigned to DHHS. Contributions by relatives are considered unearned income in determining eligibility.

Review the possibility of a liable relative at application, each redetermination, and whenever questionable. Complete and send Form 64, Statement of Legally Liable Relative, to all liable relatives.
