245.13 The Additional 3 Month Cure Period (FSM) |

ABAWDs who regain eligibility by meeting work requirements or an exemption remain eligible for SNAP benefits as long as the ABAWD continues to meet ABAWD work requirements or becomes exempt from the ABAWD work requirements. See Section 245.09, Regaining Eligibility After Closing for Failure to Meet ABAWD Work Requirements, for more information.
Non-exempt ABAWDs who fail to meet ABAWD work requirements a second time are eligible for an additional 3 months of SNAP benefits while not meeting ABAWD work requirements. Unlike the first 3 countable months, these 3 additional months must be consecutive. Partial months of eligibility do not count toward the additional 3-month period.
The additional 3-month period of receipt does not begin until the ABAWD reports that they are no longer meeting ABAWD work requirements. Because the 10-day reporting requirement still applies, the begin date for the additional 3-month period must never be later than 10 days after the ABAWD individual fails to meet the work requirement for the second time.
After receiving SNAP benefits for these additional 3 months, the ABAWD’s eligibility is terminated effective the end-date of the third full month of receipt. The ABAWD is ineligible for SNAP benefits for the remainder of the 36-month period unless the individual regains eligibility by meeting work requirements or an exemption and continues meeting work requirements or an exemption.
