305.16 General Guide to Alien Eligibility Status in the Food Stamp Program SR 03-06, 04/03 (FSM-A)

The chart below summarizes eligibility status and is to be used as a general guide only. The chart below does not replace policy stated in the whole of PART 305, Citizenship.

If.

And.

Then.

.the non-citizen meets:

   the definition of qualified alien; and

   all other food stamp eligibility requirements.

.the qualified alien also falls under the parameters of one of the following categories:

.the qualified alien is eligible for food stamp benefits.

 

Unrestricted category:

   a lawfully admitted permanent resident (LPR) with 40 qualifying quarters;

   an elderly individual born on or before 8/22/31;

   children under 18 who were lawfully residing in the U.S. on 8/22/96;

   blind or disabled individuals;

   an individual involved in active military service or a veteran (and spouses and children); or

   an individual who has lived in the U.S. for 5 years from their date of entry with the status of qualified alien.

.on an unrestricted basis.

 

Restricted category:

   Refugee;

   Asylee;

   Individuals whose deportation has been withheld;

   Cuban or Haitian entrant; or

   Amerasian immigrant.

.during the first seven years they are admitted or granted status.
