315.09 Administrative Appeals SR 13-19 Dated 09/13

Each household has the right to an *administrative appeal to appeal a denial or termination of benefits. The household must make a request for an administrative appeal either orally or in writing within 90 days of the date on the notice of the action being appealed.

If requested within 15 days from the date on the notice of the action being appealed, a recipients benefits may, under certain circumstances, be continued or reinstated at the previous level until the decision on the appeal is reached, and/or until the Food Stamp certification period ends.

If a participating individuals households benefits continue through the *administrative appeal, and the termination of benefits is upheld, the ineligibility or disqualification period begins on the first of the month after the District Office is notified of the *administrative appeal decisions. The individuals household must also repay all Food Stamp benefits that were received as a result of the continued benefits.
