611.05 Income of Disqualified and Excluded Individuals SR 96-58, 02/97 (FSM-A)

Calculate the income of individuals who are penalized for failure to follow a technical program requirement or for program violations as follows:

Disqualify individuals who are adjudicated as intentional program violators or who fail to comply with work registration or job search requirements from receiving food stamps. Count their income and resources as being 100% available to the remaining household members. The households allotment cannot increase due to the penalty being imposed.

• Apply the full amount of the countable earned income, unearned income, and resources of individuals disqualified from receiving food stamps in determining the eligibility of the remaining household.

- Apply the 20% earned income deduction to the gross earned income of these individuals when computing the households eligibility.

- Allow all other applicable deductions when computing the eligibility determination.

Exclude individuals from receiving food stamps for any of the following:

• being an ineligible alien, or

• failure or refusal to meet any of the requirements for:

- ABAWD work participation,

- SSN enumeration,

- SSN verification,

- citizenship declaration, or

- alien status declaration.

Count resources as 100% available to the remaining household members.

Prorate the excluded members gross earned income and gross unearned income among all members of the household, including the excluded member. Count as available to the household the amount of gross earned income equal to the prorated figure amount multiplied by the number of included household members.

1.  Calculate the excluded members gross earned income.

- Divide the total gross earned income amount(s) by the number of eligible and excluded household members.

- Total the amount equal to the eligible members share. Combine the prorated earned income for each eligible household member with other earned income from each eligible household member.

2.  Calculate the excluded members unearned income.

- Divide the total unearned income by the total number of eligible and excluded household members.

- Count the amount equal to the share of the eligible members. The prorated unearned income for each eligible household member is combined with their other unearned income.

3.  Prorate the shelter costs.

- Total all shelter and utility costs.

- Divide the total amount of shelter and utility costs by the number of eligible and excluded household members.

- Count the amount equal to the eligible members share.

4.  Prorate the dependent care costs.

- Total all dependent care costs.

- Divide the total amount of dependent care costs by the number of eligible and excluded household members.

- Count the amount equal to the eligible members share.

5.  Prorate other allowable deductions.

- Total all other allowable deductions.

- Divide the total amount of other allowable deductions by the number of eligible and excluded household members.

- Count the amount equal to the eligible members share.
