809 EXEMPTIONS FROM FOOD STAMP WORK REQUIREMENTS SR 97-34, 09/97 (FSM-A)

Review each individual's status to see if they are exempt from work requirements at application, redetermination, and when an individual reports a change. An individual is exempt who meets one of the following conditions:

. A person under age 16;

. A person who is age 60 or older;

. A person who is age 16 or 17, and is not head of household;

. A person who is age 16 or 17, is head of household and attends school or a training program half-time or more;

. A student who is age 18 or older, attends school or a training program half-time or more, and meets student eligibility conditions listed in Part 239; Students,

. A person who is employed or self employed and works a minimum of 30 hours weekly, or receives weekly earnings at least equal to the 30 hours multiplied by the federal minimum wage;

- The federal and state hourly minimum wage rate is $5.15. New Hampshire permits a training wage to employees under age 17 for a 90-day period;

. A regular participant in a drug or alcoholism treatment and rehabilitation program;

. A person who is physically or mentally unfit for employment;

. A person who is responsible for the care of a child under age 6 or a disabled person living in the home;

- For an exemption due to the child's age, the person must be the child's parent, foster parent, step parent, adoptive parent, guardian, adult with legal custody, or when no parent resides in the household, a member of the household exercising parental control;

. A person who is participating in the NHEP;

. A person who is entitled to NH Employment Security (NHES) unemployment insurance benefits-even if the benefits have not yet actually been received-as long as the individual is registered for work with NHES as part of the unemployment insurance process; and

. A migrant or seasonal farm worker who is under contract or similar agreement with an employer or crew chief to begin work within 30 days.
