Individuals who do not comply with food stamp work or training requirements are subject to mandatory minimum disqualification periods, based upon the number of noncompliance violations. The penalties are:
• One month for the first violation;
• Three months for the second violation; and
• Six months for the third and subsequent violations.
The disqualification period begins the first day following the expiration of the advance notice period. If a fair hearing is requested, notify New Hampshire Employment Security (NHES), who may elect to send a representative to attend the hearing. If requested within the notice period, benefits are provided to the individual during the fair hearing period.
The individual remains disqualified until:
• They become exempt, or
• The latest date in which one of the following occurs:
- the individual complies, or
- the 1, 3 or 6 month disqualification period ends.
After the disqualification period has ended, the noncomplying member may again participate in the food stamp program and must comply with future work requirements. The individual must be included as a household member effective with the first allotment issued following the end of the disqualification period.
