CHILD SUPPORT SR 13-36, 11/13 (MAM-A)

Payments made by the absent parent on behalf of a child that represents payments for maintenance and care, including any amount diverted from court-ordered support to a third party when the court has not ordered the diversion. The income is considered to be the child’s. If one child support payment is made on behalf of more than one child, prorate the payment among the children to determine an amount for each. This includes any amount diverted from court-ordered support (or other binding agreement) to a third-party to pay the household’s expenses when the court has not ordered the diversion. If spousal support is included in the same payment with child support, a prorated share is considered to be the spouse’s.

Treatment: Unearned Income

Any portion of a child’s support made payable to – and retained by – the state.

Treatment: Excluded Income for grant computation in the benefits test. It is not excluded from the eligibility test.
